Represent Me?
In
our first meeting, we will begin to
gather the information needed to evaluate
your case and advise you. Some matters
can be handled without hiring an attorney,
and if you have such a case, we will
tell you!
Remember that all information
you share is protected by the attorney/client privilege,
and is confidential between
you and your attorney. It is important
that you share all information, and
have insurance booklets, pictures,
medical bills, and any other relevant
papers with you.
Investigating Your Claim
After the interview, we investigate your
claim. We attempt to locate and identify
witnesses and gather evidence. If you
were harmed by a defective product,
that item must be preserved and examined
by experts. We will also collect your
medical records, based on your identification
of hospitals and doctors that treat
you.
After investigating your claim fully
and learning the extent of your injury,
we can appraise the
value of your claim. If possible, we
attempt to settle your case before
a lawsuit if filed.
You are
ultimately in charge of the result
of your case! No one can settle
your case or go to court on your case
without your permission. We will advise
you throughout the process, but the
decision to settle or not is ultimately
yours.
If settlement negotiations are unsuccessful,
a lawsuit is filed. Occasionally, a
claim cannot be settled until
after a lawsuit is filed and
the insurance company realizes that
the injury victim will pursue
justice rather than accept
an unfair settlement.
Most cases settle
after a lawsuit is filed, especially
when the case is handled by a skilled
and experienced trial lawyer. For those
that do not, trial is the next step.
