A recent Missouri decision means that workers’ compensation doesn’t rule out negligence lawsuits

Most Missouri employees have considered workers’ compensation as the exclusive remedy for workplace accidents. If you were hurt by a coworker, the only way to recover damages for your injuries was to file a “work comp” claim.

But that has now changed.

A recent Missouri Court of Appeals decision allows employees who are injured at work to sue their co-workers for negligence in addition to filing worker compensation claims against the employer.
